Federal Court: Obama's 'Executive Action on Immigration Is Unconstitutional'

CNSNews.com) - A judge for the U.S. District Court for the Western District of Pennsylvania issued a "memorandum opinion" on Tuesday stating that President Barack Obama's unilateral action on immigration--which would allow some illegal aliens to stay in the United States and work--is unconstitutional.

Pat Buchanan: Rogue President

Asserting a legal and constitutional authority he himself said he did not have, President Obama is going rogue, issuing an executive amnesty to 4 to 5 million illegal aliens.

He will order the U.S. government not to enforce the law against these 5 million, and declare that they are to be exempt from deportation and granted green cards.

Where did Obama get his 4-5 million figure, not 2-4 million, or 5-7 million? Nowhere in law, but plucked out of his own mind, as to what he can get away with. Barack Obama just felt it was about right.

Thus does our constitutional law professor-president “faithfully execute” the laws of the United States he has twice swore to uphold?

How the GOP Lost Middle America

Out of the Republican retreat on Maryland’s Eastern shore comes word that the House leadership is raising the white flag of surrender on immigration.

The GOP will agree to halt the deportation of 12 million illegal aliens, and sign on to a blanket amnesty. It only asks that the 12 million not be put on a path to citizenship.

The Heretic at Heritage

Jason Richwine, the young conservative scholar who co-authored the Heritage Foundation report on the long-term costs of the amnesty bill backed by the “Gang of Eight,” is gone from Heritage.

He was purged after The Washington Post unearthed his doctoral dissertation at the JFK School of Government.

Richwine’s thesis:

IQ tests fairly measure mental ability. The average IQ of immigrants is well below that of white Americans. This difference in IQ is likely to persist through several generations.

And the potential consequences of this?

Supporting amnesty for illegal immigrants has earned South Carolina Senator Lindsay Graham the opposition of NumbersUSA , a border security group that began a statewide radio ad campaign against Senator Graham on Tuesday, saying television ads would follow today.

Sen. Lindsey GrahamGraham, is a member of the Senate “gang of eight,” a bipartisan group pushing for a comprehensive immigration “reform” bill that includes a “path to citizenship” or amnesty for those who came to this country illegally.

According to NewsMax, although Graham is the first member of the “gang of eight” to be targeted, NumbersUSA says it plans to run negative ads about the other seven members of the group: Sen. John McCain, R-Ariz., Sen. Marco Rubio, R-Fla., Sen. Jeff Flake, R-Ariz., Sen. Chuck Schumer, D-N.Y, Sen. Dick Durbin, D-Ill., Sen. Bob Menendez, D-N.J., and Sen. Michael Bennet, D-Colo.

NumbersUSA, which believes a pathway to citizenship for illegal immigrants would only draw more illegal immigrants to the U.S., plans to spend $150,000 on its anti-Graham ad campaign, says NewsMax.

The GOP's Amnesty Caucus Raises the White Flag

On Monday, Sens. John McCain, Lindsey Graham, Jeff Flake and Marco Rubio emerged with an offer of a Republican surrender to Barack Obama.
We will accept amnesty for 11 million illegal aliens, said the four, but you must get serious about securing the border against yet another invasion. Only after an independent commission agrees the border has been secured will the 11 million be given green cards and put on a path to citizenship.

The Bishops' Immigration Obsession


The Catholic Church in America has suffered in recent decades from rapidly declining Mass attendance. Its higher education institutions have pushed Catholicism out of the curriculum and culture, with no real catechesis program for young adults. And efforts to attract more young people to the Church have looked more like a “cool” Dad trying to right a fumbled relationship with his children.

Francis Cardinal George, archbishop of Chicago and former president of the U.S. Conference of Catholic Bishops, recently announced a new effort to “nurture the faith and intellectual and moral development of our youth.” Cardinal George says that young people “encourage us with their passion to learn and their desire to create a better world.”

Yet the particular way the cardinal is calling attention to the development of young people is for the Catholic community to “support and promote the passage of the DREAM Act and the eventual goal of the passage of compassionate comprehensive immigration reform legislation.”

Obama 'Defiance' of Constitution Earns Impeachment Call

'What use are elections if the executive branch rules by decree?'
 
An organization that battles illegal immigration on behalf of the 75 percent of America's legal citizens who want more control over illegal immigration is calling for the impeachment of Barack Obama over his involvement in two issues: the transfer under his administration's jurisdiction of weapons to Mexican drug lords and his efforts to provide amnesty to illegal aliens.

"President Obama is no longer the legitimate president of the United States," said William Gheen, president of Americans for Legal Immigration PAC, in calling for the action today.

"By arming drug and human smugglers with assault weapons that have been used to kill American and Mexican citizens and police forces, and by ordering amnesty for illegal aliens which has been rejected by both the Congress and the American public more than eight times, Obama has committed a form of treason against the United States and must be removed from office by Congress," he said.

Schumer and Graham: Partners in Amnesty

With reports that the worst Republican Senator is teaming up with New York Senator Charles Schumer on a new amnesty bill for illegal immigrants, we have only one question about Lindsey Graham: "who is blackmailing him?"  As the following story indicates, Grahamnesty has destroyed himself in the eyes of South Carolina Republican primary voters.

South Carolina should amend its constitution to allow for recall of the scoundrel canceling out Senator Jim DeMint's votes; fortunately there are many distinguished prospects for his seat in 2014 -- Henry McMaster, Joe Wilson, Bill Connor, among others.  We will enthusiastically support the Republican who has the best chance of defeating him.

Sen. Lindsey Graham (R-SC), who has both bad-mouthed and praised the Tea Party movement in the past, isn't up for re-election until 2014. But when that comes, a new survey from Public Policy Polling (D) finds that Graham could be quite vulnerable in his Republican primary -- against Congressman Joe "You Lie" Wilson!

The poll finds that only 42% of the state's Republican primary voters approve of Graham's performance, with 40% disapproving. And in a hypothetical primary against Wilson, who famously shouted out "You lie!" during a speech on health care by President Obama to Congress, it doesn't look good for Graham: Wilson gets 43% of the votes, and Graham gets 41%. The margin of error ±4.1%.

"Lindsey Graham should thank God his next race is not until 2014," writes PPP president Dean Debnam. "He'd be in good shape in November, but at this rate, he'd be lucky to survive that far."

On the other hand, Graham does lead former Gov. Mark Sanford by a margin of 52%-34%. Unfortunately for Sanford, while he might have a lot of experience campaigning in Buenos Aires and on the Appalachian Trail, those voters likely aren't eligible to participate in South Carolina elections.

Beaten and Bitter, Bob Inglis Votes for Amnesty

Congressman Bob Inglis, along with seven other Republicans, joined Democrats in the lame-duck session of Congress to pass the DREAM Act amnesty bill last night in a vote of 216-198.

Republicans voting for amnesty were:

DELAWARE - Castle
FLORIDA - L. Diaz-Balart
FLORIDA - M. Diaz-Balart
FLORIDA - Ros-Lehtinen
HAWAII - Djou
LOUISIANA - Cao
MICHIGAN - Ehlers
SOUTH CAROLINA - Inglis  

Thirty-eight Democrats voted against amnesty, and 20 members failed to vote.

The legislation will now be taken up by the Senate, where there will be a cloture vote.  If fewer than 60 of the 100 Senators vote for cloture, so that debate on the legislation can begin, the amnesty bill will be dead.  A vote is expected as early as this morning.

Please call the Senate at 202-224-3121, ask for your Senators, and urge them to vote NO on the DREAM Act.

Kyl: Obama Uses Border Insecurity to Push Immigration Plan

The Obama administration is using the increasing insecurity of the Mexican border to push through its own agenda on immigration, according to Arizona Sen. Jon Kyl.

In a video clip posted on YouTube showing the senator speaking to a local Tea Party crowd on Friday, Kyl aid the president told him during a one-on-one meeting in the Oval Office that he was concerned he wouldn't win GOP support on immigration legislation if he took care of border security first.



"The problem is, he said, if we secure the border, then you all won't have any reason to support comprehensive immigration reform," Kyl said, as the crowd in the room gasped loudly. "In other words, they're holding it hostage."
